Clarimon Terms of Service

Thanks for choosing Clarimon! These Terms of Service ("Terms") govern your use of our accounting platform ("Service"). By creating an account or using Clarimon, you agree to these Terms. If you're signing up on behalf of a company, you confirm you have the authority to bind that company.

Clarimon is operated by Internuity Internet cc (Reg: 2008/141724/23; Address: 13 Chroom Street, Jukskei Park, Randburg, 2188, South Africa).

We've tried to write these Terms in plain language. If anything is unclear, contact us — we're happy to explain.


1. Your Clarimon Account

1.1 Registration

To use Clarimon, you need a valid email address and must provide accurate information about your business. Each Clarimon account is set up to support one business ("your Business"). If you run multiple businesses, you'll need a separate account (with its own subscription) for each one, so that each business's books stay properly separated.

1.2 Who Can Use Clarimon

You must be authorized to manage the financial records of the Business you're adding to Clarimon. If you're an accountant or bookkeeper managing the account on behalf of a client, you confirm you're authorized to do so.

1.3 Account Security

You're responsible for keeping your login credentials secure. Tell us immediately if you suspect any unauthorized access to your account.

1.4 Compliance with Laws

You agree to use Clarimon in accordance with all laws and regulations that apply to your Business, including tax and financial record-keeping laws.


2. Acceptable Use

You must not use Clarimon for anything illegal, fraudulent, or abusive. In particular, you agree that you will not:

Breach of these Terms may result in suspension or termination of your account. Where we terminate for breach, your current subscription ends immediately and you will not be refunded for previous payments, except where required by applicable law.


3. Pricing and Subscriptions

3.1 Single Plan, All Features Included

Clarimon offers one subscription plan that includes all features — there are no "tiers" that lock functionality behind a higher price.

3.2 Unlimited Storage, Fair Use

Your subscription includes unlimited storage for documents related to your Business's accounts (see Section 2 for what this storage may be used for). We reserve the right to review accounts using storage in a way that's clearly inconsistent with normal accounting use for a business of their size, and to contact you if we have concerns.

3.3 Automatic Revenue-Based Discount

Smaller businesses automatically qualify for a discount based on monthly revenue, calculated from the financial data recorded in your own Clarimon account (e.g., your revenue accounts and income transactions). This means:

3.4 Billing and Renewal

Your subscription bills automatically at the start of each billing cycle and renews automatically unless you cancel before the cycle ends. Fees are charged in advance and are non-refundable unless otherwise stated in these Terms (see Section 4).

Before you complete a purchase, we'll show you what you're buying (subscription and any add-ons), the price, and the billing period you're committing to. Charges on your payment statement will identify Clarimon so you can recognize the purchase.

3.5 Price Changes

We may change our pricing or discount structure from time to time. We'll notify you in advance, and any changes take effect from your next billing cycle.

3.6 Cancellation

You can cancel anytime from your account settings or by contacting support. Cancellation takes effect at the end of your current billing cycle and stops further charges. Cancelling does not automatically refund the current period — see Section 4 for when refunds apply.

3.7 Add-Ons and Bundles

From time to time, we may offer optional add-ons (for example, OCR scanning bundles) in addition to your subscription. Add-ons:

4. Refunds

Nothing in these Terms limits your mandatory consumer rights. If applicable law gives you stronger rights than this section, those rights apply.

By completing a purchase, you acknowledge that you have 30 days from the order completion date to cancel or request a refund under our money-back guarantee (subject to the exceptions below).

4.1 30-Day Money-Back Guarantee

If you're not satisfied with Clarimon, you may request a full refund within 30 days of the relevant order completion date (for a subscription, that means within 30 days of the payment for that billing period; for an add-on, within 30 days of that add-on purchase), subject to Section 4.2 on consumed usage.

If a refund is approved, access to the relevant product or billing period will end.

4.2 Consumed Usage

Where you purchase usage-based add-ons or credits (for example, OCR scans sold per page), any units you have already used or consumed are not refundable.

If you request a refund within an applicable refund window, we may issue a partial refund for unused units only. Used units remain charged, and we may deduct their value from any refund. Once usage has been consumed, it cannot be restored by reversing the purchase.

4.3 Statutory Withdrawal Rights

Depending on where you live, consumer law may give you an additional right to withdraw for any reason within a cooling-off period after purchase (for example, 14 days in many jurisdictions). Where those rights apply, they override any conflicting terms in this section.

4.4 Faulty, Misdescribed, or Unfit Products

You are entitled to a remedy (repair, replacement, or refund, as applicable) if Clarimon is not as described, faulty, or not fit for purpose. This cannot be waived by these Terms.

4.5 Non-Delivery and Technical Failure

If we fail or unreasonably delay in delivering access to Clarimon due to technical issues on our side, you are entitled to a replacement or a refund of the relevant charges paid.

4.6 How to Request a Refund

To request a refund or exercise a withdrawal right, contact Clarimon support with your account email and order details.

Eligible refunds are typically returned to the original payment method within 14 days of approval.

4.7 When We May Decline a Refund

We may decline a refund where:

Outside the refund windows above, cancelling your subscription still stops future billing at the end of the current cycle (see Section 3.6).


5. Complaints

5.1 How to Complain

If you have a complaint about Clarimon, billing, or these Terms, please contact us with:

Complex matters may take longer. If so, we'll tell you and keep you updated, with a target resolution of 30 business days unless circumstances reasonably require more time.

5.3 If You're Not Satisfied

If we can't resolve your complaint to your satisfaction, you may escalate to the appropriate consumer or trade ombudsman or regulator in your country.

For consumers in South Africa, that includes the Consumer Goods and Services Ombud (CGSO) and the National Consumer Commission. Buyers elsewhere should use their local consumer protection authority or ombudsman where available.


6. Data Accuracy and Professional Advice

This section is important, so we've kept it as plain as possible.

6.1 Clarimon Is Not a Substitute for an Accountant or Tax Advisor

Clarimon helps you record, organize, and report on your financial data. It does not provide accounting, tax, legal, or financial advice. Reports, tax calculations, and summaries generated by Clarimon are based on the data you enter — they are not professional advice, and you should have a qualified accountant or tax advisor review your accounts and filings, especially for anything submitted to a tax authority.

6.2 You're Responsible for Your Data

You are responsible for the accuracy of the transactions, categories, and documents you (or your bookkeeper/accountant) enter into Clarimon. We don't independently verify the correctness of your data, and we're not liable for decisions, filings, or claims you make based on it.

6.3 Keeping Independent Copies of Your Records

Tax and business record-keeping laws in many jurisdictions require you to retain accessible financial records for a number of years. We recommend keeping your own independent copies of important records (for example, using our export tools from time to time) so you have access to them for audits or compliance purposes, independent of your Clarimon account status.

6.4 Bank Connections and Third-Party Data

Where Clarimon connects to your bank (directly or through a third-party data provider) to import transactions or statements, that connection is subject to the terms of your bank and/or that data provider. We're not responsible for outages, errors, or delays caused by your bank or a third-party data provider, though we'll do our best to help resolve issues.


7. Cancellation and Termination

7.1 Closing Your Account

You may close your Clarimon account at any time. When you close your account, we will provide you with a full export of your data before deletion. After closure, we'll retain your data for 60 days (in case you need to request this export or change your mind), after which it will be permanently deleted.

7.2 Termination for Abuse

We may suspend or terminate accounts that breach Section 2 (Acceptable Use). Where possible, we'll warn you first and give you a chance to fix the issue, except in cases of serious or repeated abuse.


8. Intellectual Property

The Clarimon source code, design, and platform architecture are protected by copyright and may not be used without our prior written consent. You retain ownership of the financial data and documents you upload — we don't claim any ownership over your Business's records.


9. Changes to These Terms

We may update these Terms from time to time. Where changes are significant, we'll notify you in advance (e.g., by email) rather than just updating the page silently. The current version will always be available at /terms.


10. Disclaimers

10.1 Service Availability

Clarimon is provided "as is" and "as available." We may modify, suspend, or discontinue the Service — or any feature, tool, or add-on within it — at any time, with or without notice. Where a change is significant, we'll try to notify you in advance. You agree that Clarimon will not be liable to you for any modification, suspension, or discontinuance of the Service or any part of it, except as required by law or under Section 4.

10.2 No Warranty on Data Correctness

As set out in Section 6, we don't warrant the correctness of data you enter, and we're not responsible for corruption or loss of data beyond our reasonable control (which is why we recommend keeping independent copies of important records).


11. Limitation of Liability

11.1 General

To the extent permitted by law, Clarimon is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including any tax, accounting, or compliance consequences resulting from decisions you make based on data in Clarimon.

11.2 Maximum Liability

Our total liability to you for any claim will not exceed the amount you paid us for the Service in the 12 months before the claim arose.


12. Indemnification

You agree to indemnify and hold Clarimon and its officers, employees, and agents harmless from third-party claims arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right.


13. Miscellaneous

13.1 Severability

If any part of these Terms is found invalid or unenforceable, the rest will remain in full effect.

13.2 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of South Africa.
